No, it’s not legal unless they have permission from Nintendo. Sites get away with it because it’s so easy to make a website that it’s hard to catch them all.
Whether it’s moral is another story. Just because a game is old doesn’t mean it has no value - a lot of old games are still sold in collection packs or on handheld consoles or as downloadables. On the other hand, if you’ve ever paid for the game - if it’s an old Nintendo game that you used to own the NES cartridge for but your NES is long since broken - then it’s not really ‘wrong’ to play the game, because you DID support the company.
The purpose behind paying for games isn’t just to obey the law, it’s to support the companies so they can make more games. If lots of people buy SuperGame, then the company will stick around to make SuperGame 2. If nobody buys SuperGame, it vanishes and there are no sequels. Generally.
Usually, if you go to a site that has the games on it, they say it is to be used for”education” or “review” purposes only, and you are “supposed” to delete the data after 24 hours. It is up to the individual at that time if they keep the data or not. If the site is owned by the holder of the game’s copywriter, the games are”legal”. Most people have been”pirates” and not really known they were anyway.
